What is the No Surprises Act?

Passed as part of the Consolidated Appropriations Act of 2021 and effective January 1, 2022, the No Surprises Act protects patients from unexpected, or “surprise”, medical bills in situations where they had limited choice over which provider treated them. It ensures you are only ever charged what you’d expect to pay based on your coverage, and that uninsured patients receive a written cost estimate before treatment begins.

Key Provisions You Need to Know

Protection From
Surprise Bills

You cannot be billed more than your in-network cost-sharing amount for emergency services, even when treated at an out-of-network facility or by an out-of-network provider you did not choose.

Good Faith
Estimates

If you are uninsured, or choose not to use insurance, you are entitled to a written Good Faith Estimate of expected costs before scheduling or receiving care.

Prior Consent
Required

In non-emergency situations, out-of-network providers must get your written consent before treating you, clearly explaining you can seek an in-network provider instead.

Independent
Dispute Resolutio

If you receive a bill that violates the Act, you have the right to challenge it through an independent dispute resolution process, at no cost to you to initiate.
